§ 1
Definitions

For the purpose of this Terms of Service, the following definitions shall apply:

1. Conference – AgileByExample conference taking place 26–28 September 2022 in Warsaw.

2. Consumer – a natural person who concludes a contract with the Organiser which is not directly related to the Consumer’s business or professional activity,

3. Buyer – a natural person having full legal capacity, legal person or imperfect legal person concluding an Agreement with the Organiser; Buyer can be a Participant,

4. Organiser – Superskrypt Sp. z o.o. (Co Ltd) Sp. k.(LP), ul. Ludwika Narbutta 50/3, 02-541 Warsaw, Poland, NIP (Tax Identification Number): 5213765226, REGON ( National Business Registry Number): 366052111, KRS (National Court Register): 0000643210, registry court: District Court for the City of Warsaw in Warsaw, XIII Commercial Department of the National Court Register, e-mail: info@agilebyexample.com,

5. Regulations – this document is available at https://agilebyexample.com,

6. Conference Website – a website available at https://agilebyexample.com,

7. Participant – a natural person having full legal capacity, participating in the conference,

8. Agreement – an agreement concluded between Organiser and Buyer, by virtue of which the Organiser undertakes to provide participation in the Conference to buyer or persons indicated by the buyer.

§ 2
Preliminary provisions

1. Conference is organised by the the Organiser.

2. The conference is held on September 26-28, 2022 in Warsaw

3. Conference is divided into two parts:

1) the “Dojo” part takes place on September 26, 2022 at Centrum Konferecyjne Zielna.

2) The “ABE22” part takes place on September 27-28, 2022 at Multikino Złote Tarasy.

4. You can participate only in the “ABE22″ part or in both “Dojo” and “ABE22”.

5. All details concerning the Conference, such as program, profiles of speakers, descriptions of individual speeches, are available on the Conference Website. The Organiser reserves the right to make changes to the Conference program due to circumstances independent of him. Any changes will be announced on the Conference Website.

6. Organiser reserves the right to cancel or postpone the date of the Conference, as well as to change the place of the Conference due to circumstances independent of the Organiser. In the event of cancellation of the Conference, Buyers will receive a refund of the entire amount paid for the tickets. In the event of changing the place or time of the Conference, the buyer may withdraw from the Agreement within 7 days of being informed about the change. In this situation, the buyer will receive a refund of the entire amount paid for the tickets.

7. Participation in the Conference is payable as subject to paragraph 8 below. Conference participation fees are posted on the Conference Website and are expressed in net amount, to which VAT should be added according to the currently applicable rate in the Republic of Poland. The Organiser reserves the right to grant discounts on the prices posted on the Conference Website.

8. Organiser has the right to provide free admission to the Conference for persons of his choice, in particular for sponsors, speakers, media representatives, winners of competitions, persons involved in the organization of the Conference. Nevertheless, in accordance with the provisions of § 4 of the Regulations, such persons shall go through the registration process using the voucher provided by the Organiser allowing free admission.

§ 3
Purchase of the tickets

1. Participation in the Conference is possible if a participant has purchased the ticket.

2. The purchase of the tickets is possible via the Conference Website.

3. The following steps should be followed in order to purchase the tickets:

1) choose the type of ticket enabling you to participate in the Conference,

2) specify the number of tickets,

3) go to the cart,

4) fill out the order form, providing your first and last name or company name, e-mail address, telephone number, address of residence or address of the company, NIP (tax identification number) and any additional comments if needed,

5) choose the payment method (traditional bank transfer or online payment with a debit card via PayPal or online payment via Przelewy24),

6) accept the Regulations,

7) click the button that finalizes your order.

4. If you choose online payment, after clicking the button finalizing the order you will be redirected to the respective payment gateway to make a payment. If the payment is successful, you will be redirected to the Website with the payment confirmation.

5. If you choose payment by traditional bank transfer, after clicking the button finalizing the order you will be redirected to the page with confirmation of registration and data required to make the transfer

6. As part of the order form it is possible to provide a discount code in order to reduce the amount to be paid.

7. An email confirming the purchase of tickets and details related to participation in the Conference will be sent to the e-mail address provided during registration. It will include information related to providing the Organiser with the actual data of the Conference participants (so-called registration of participants).

8. Invoice will be sent to buyer electronically to the e-mail address provided in the order form.

9. For each Buyer, a user account will be created on the Conference Website. The account can be accessed using the email address and password provided in the order form. From the account level, the buyer can manage his account data and details related to the Conference. The account can be deleted at any time. In order to do that, contact the Organiser. Deleting an account does not delete the information about the order.

§ 4
Free registration

1. Persons who are provided free admission to the Conference are requested to go through the registration process corresponding to the purchase of tickets described in § 3 of the Regulations. Instead of buying tickets, participants will be registered for free after providing vouchers obtained from the Organiser.

2. For the avoidance of doubt, any person having assured participation in the Conference, in particular speakers, that will not go through the registration process described in § 3 of the Regulations, become a participant and is supposed to abide by the provisions of the Regulations.

§ 5
Admission to the Conference area

1. Admission to the Conference area is possible after confirming attendance at the registration desk. Confirmation of attendance also applies to all Participants who are provided free admission to the Conference, in particular speakers.

2. By confirming their attendance, Participant will receive an individual ID and start materials.

3. Confirmation of attendance is tantamount to acceptance of the Regulations. The document is available to participant for review at the registration desk referred to in paragraph 1 above. In addition, the Regulations are available on the website https://agilebyexample.com.

4. Organiser reserves the right to refuse admission to the Conference area to persons in the state indicating consumption of alcohol or other intoxicating substances, aggressive persons or persons who threaten safety of others. In such a situation, buyer shall not be entitled to a refund of payment or any part thereof made under the Agreement.

5. No objects that may pose a threat to security such as: weapons, explosives, toxic agents, stimulants, all kinds of defensive gases, may be brought to the Conference. Organiser reserves the right to inspect items brought to the Conference. In the event of finding prohibited items, organiser does not provide them with a deposit. Refusal of admission to the Conference due to possession of prohibited items does not give buyer the right to demand a refund of the payment, or any part thereof, made under the Agreement.

§ 6
Behaviour during the conference

1. The participant is obliged to use real (legal) data in the conference, including personal data.

2. Participants of the Conference are obliged to behave in a cultural manner that does not interfere with the course of the Conference, public order, does not violate the personal rights of other Participants, does not adversely affect Organiser’s reputation or otherwise harms the Organiser or other Participants.

3. In the event of behaviour contradictory to the provisions of paragraph 1 or 2 above, the Organizer is entitled to remove the Participant from the Conference and prevent him from joining the Conference again. In such a situation, the buyer shall not be entitled to a refund of payment or any part thereof made under the Agreement.

4. Due to the inability to predict all threats related to the behaviour of Participants during the Conference, the Organiser reserves the right to make decisions on unforeseen matters not described in the Regulations. If such a decision leads to the exclusion of the Participant from participation in the Conference, the buyer is not entitled to a refund of payment or any part thereof made under the Agreement.

§ 7
Benefits of the Organiser

1. Organiser provides Participants of the Conference with the opportunity to participate in all lectures, workshops, panels, etc. taking place during the Conference and post-conference materials.

2. By creating the opportunity for the buyer to participate in the Conference, the Agreement is considered executed by the Organiser. In a situation where buyers or Participants for whom the buyer has bought Conference tickets, will not participate in the Conference or any part thereof, and there has not been an effective withdrawal from the Agreement or termination of the Agreement by mutual agreement of the parties, the buyer is not entitled to refund payment, or any part thereof, made under the Agreement.

§ 8
Public image

1. Participant acknowledges that during the Conference photos, video or audio-video recordings or transcripts may be taken to create and then disseminate online reports from the Conference.

2. Organiser hereby informs participant that in accordance with art. 81 paragraph 2 point 2 of the Act on Copyright and Related Rights, the permit does not require the dissemination of the image of a person constituting only a detail of the whole. Regardless of that, by taking part in the Conference, the participant agrees to the dissemination of his image recorded in the photographs and videos taken during the Conference. The consent includes the distribution of photos and videos for the purposes of reporting, reviewing, describing or promoting the Conference online. Withdrawal of consent is possible by contacting the organiser, in particular via e-mail (gdpr@agilebyexample.com) Withdrawal of consent acts only for the future and does not affect the legality of the image being disseminated before the consent is withdrawn.

3. In a situation in which the participant voluntarily participates in the video recording, giving a short speech, he agrees to use his image, name and surname, official position, potential information about the employer, the institution he represents, the voice and statements given in front of the camera, in order to disseminate the recordings for purposes related to reporting, reviewing, describing or promoting the Conference. Participant’s consent may be revoked at any time. Withdrawal of consent is possible by contacting the Organiser, in particular via e-mail (gdpr@agilebyexample.com) Withdrawal of consent acts only for the future and does not affect the legality of the image being disseminated before the consent is withdrawn.

§ 9
Personal data

1. The administrator of Buyers’ personal data is the Organiser.

2. If the buyer provides personal data of other Participants to the Organiser, he declares that he is entitled to do this in order to provide Participants with admission to the Conference and he also declares he informed such persons about the purpose of data provision and processing of such data.

3. Personal data of Buyers and Participants are processed by the Organiser to execute the Agreement (art. 6 paragraph 1 point b of the GDPR), to comply with the accounting obligations arising from the law (art. 6 paragraph 1 point c of the GDPR), in order to establish, investigate or defend claims and for statistical purposes, which is a legitimate interest of Organiser (art. 6 paragraph 1 point f of the GDPR).

4. Organiser entrusts the processing of personal data of Buyers and Participants to his subcontractors, such as accounting office, hosting provider, e-mail service provider, mailing system provider, courier company, entities providing services to Organiser related to the organization of the Conference.

5. Due to the fact that Organiser uses Google services, the data of Buyers and Participants can be transferred to the United States of America (USA) to be stored on Google servers. Google joined Privacy Shield program, which means that it guarantees an adequate level of protection of personal data required by European regulations.

6. The personal data of Buyers and Participants will be stored until the expiry of the period of limitation of claims under the Agreement, and then for statistical purposes until the Organiser discontinues running a business. After the expiry of the limitation period for claims under the Agreement, Buyer or Participant may oppose further processing of their personal data, which will result in the deletion of data. Personal data contained in accounting documents will be kept for the period required by law.

7. Organiser may provide some additional benefits or opportunities for participants of the previously organized editions of the Conference. If Buyer or Participant requests removal of data from Organiser’s database, it will be impossible to use these benefits or opportunities.

8. As part of post-conference activities, participants may receive e-mails related to the Conference. Participants may, at any time, object to this by unsubscribing from the subscription list by clicking on the button visible in each message sent to them. If a participant unsubscribes from the subscription list, he should be aware of the possibility of not receiving all of the conference materials.

9. Regarding the image of participants, materials containing images may be disseminated online and thus it is not possible to clearly indicate the period of processing personal data in the form of an image. Participant has the right to request the removal of materials containing his image. Such request does not affect the legality of the previously disseminated material, which is disseminated on the basis of the law (Article 81 of the Copyright Act) or on the consent of the participant referred to in § 8 of the Regulations.

10 In connection with the processing of personal data by the Organiser, Buyers and Participants have the following rights:

1) the right of access to their personal data,

2) the right to rectification of their personal data,

3) the right to the erasure of their personal data,

4) the right to restriction of processing of their personal data,

5) the right to object to the processing,

7) the right to data portability,

7) the right to lodge a complaint to the supervisory authority

11. Implementation of the rights is possible through individual contact with the organiser, in particular by e-mail (gdpr@agilebyexample.com) Organiser informs Buyers and Participants that their rights referred to above are not absolute and may give way to the overriding interests of the organiser as the administrator of the personal data. The Organiser encourages Buyers and Participants to read the article. 16 – 21 of the GDPR. In order to make it easier for Buyers and Participants to understand the provisions referred above, the Organiser hereby lists examples of situations when the respective rights of Buyers or Participants cannot be realized:

1) correcting data provided in an invoice is possible only by using an invoice correction or a correction note,

2) deletion of data regarding concluded Agreements will not be possible earlier than after expiration of the contractual claims period,

3) objections to the processing of Participants’ data will not be possible during the execution of the Agreement, as this would make it impossible for the Organiser to properly execute it.

12. Providing personal data is voluntary, but necessary to conclude the Agreement and participate in the Conference.

§ 10
Intellectual property rights

The Organiser hereby instructs Participants that the materials made available to Participants in connection with participation in the Conference, as well as the content presented during the Conference may be protected by copyright and industrial property rights, and their further dissemination may constitute a violation of rights of entitled entities giving grounds for civil or criminal liability.

§ 11
Complaints

1. All complaints related to the Conference may be submitted in writing to the Organiser’s address or in electronic form to the email address info@agilebyexample.com.

2. The complaint should contain data allowing the identification of the person submitting a complaint as well as contact information, the justification for the complaint and the related demands.

3. Complaints shall be considered within 14 days from the date of submission of the complaint to the Organiser. The Organiser will address the complaint in the same form in which the complaint was submitted to him.

§ 12
Resignation

1. Each Buyer may withdraw from the Agreement concluded with the organiser no later than 14 days before the first day of the Conference. Withdrawal consists of 30% of the amount paid to the Organiser under the Agreement and will be deducted by the Organiser from the amount refunded to the buyer. It is also possible to withdraw from the Agreement partially, i.e. in the scope of only some of the purchased tickets entitling to participate in the Conference. The return of payment after deduction will be made not later than within 14 days from informing the Organiser of withdrawal from the Agreement.

2. In addition, the Consumer may withdraw from the Agreement concluded with the Organiser without giving a reason within 14 days from the date of concluding the Agreement, but no later than 14 days before the first day of the Conference. For this purpose, the Consumer must inform the Organiser about his decision, for example by sending an e-mail to info@agilebyexample.com. In such a situation, the Organiser will return all payments to the Consumer under the Agreement. The payments shall be returned immediately but no later than within 14 days from informing the organiser of withdrawal from the contract.

3. Consumer rights referred to in paragraph 2 above, are also entitled to a natural person concluding a contract directly related to his business activity, if the content of this contract shows that he does not have a professional character for that person, resulting in particular from the subject of his business activity, made available on the basis of the provisions of the Central Business Activity Records and Information.

4. For the avoidance of doubt, the Organiser hereby informs the buyer that in the situation where the buyer is not a Consumer, the buyer can not withdraw from the Agreement later than 14 days before the first day of the Conference. If buyers or Participants do not take part in the Conference, the buyer shall not be entitled to a refund of the payment made under the Agreement.

§ 13
Other provisions

1. The regulations have been prepared based on Polish law. The law applicable to the Contracts is Polish law, however, it does not deprive Consumers of the possibility to refer to the provisions of their national law.

2. All disputes arising in connection with the Terms of Service or the Contract shall be settled by the Polish common court having jurisdiction over the organiser’s place of residence. This provision does not apply to Consumers, for whom the general place of jurisdiction of the court applies.

3. Consumer has the ability to use non-judicial ways of considering complaints and assertions for claims. Inter alia, the Consumer has the ability to:

1) ask the Permanent Consumer Arbitration Court requesting the settlement of the dispute arising from the concluded contract,

2) ask the provincial inspector of Trade Inspection requesting initiation of the mediation proceedings on the amicable settlement of the dispute between Consumer and Website Owner

3) ask for assistance from the district (municipal) consumer advocate or social organization which statutory tasks include the protection of the consumer.

4. More detailed information on non-judicial ways of considering complaints and assertions for claims can be found at http://polubownie.uokik.gov.pl.

5. The Consumer may also use the ODR website available at  http://ec.europa.eu/consumers/odr. The Store is used as a means of settlement of disputes between Consumers and entrepreneurs seeking non-judicial ways of settlement of the dispute concerning contractual obligations arising from the electronic sales contract or service contract.

§1
Definicje

Na potrzeby niniejszego regulaminu przyjmuje się następujące znaczenie poniższych pojęć:

1. Konferencja – konferencja AgileByExample odbywająca się w dniach 26–28 września 2022 roku w Warszawie.

2. Konsument – osoba fizyczna zawierająca z Organizatorem umowę niezwiązaną bezpośrednio z jej działalnością gospodarczą lub zawodową,

3. Kupujący – osoba fizyczna posiadająca pełną zdolność do czynności prawnych, osoba prawna lub ułomna osoba prawna zawierająca z Organizatorem Umowę; Kupujący może być jednocześnie Uczestnikiem,

4. Organizator – Superskrypt Sp. z o.o. Sp. k., ul. Ludwika Narbutta 50/3, 02-541 Warszawa, NIP: 5213765226, REGON: 366052111, KRS: 0000643210, sąd rejestrowy: Sąd Rejonowy dla m. st. Warszawy w Warszawie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego, e-mail: info@agilebyexample.com,

5. Regulamin – niniejszy regulamin dostępny pod adresem https://agilebyexample.com,

6. Strona Konferencji – strona internetowa dostępna pod adresem https://agilebyexample.com,

7. Uczestnik – osoba fizyczna posiadająca pełną zdolność do czynności prawnych biorąca udział w Konferencji,

8. Umowa – umowa zawierana pomiędzy Organizatorem a Kupującym, mocą której Organizator zobowiązuje się zapewnić udział w Konferencji Kupującemu lub osobom wskazanym przez Kupującego.

§2
Postanowienia wstępne

1. Konferencja organizowana jest przez Organizatora.

2. Konferencja odbywa się w dniach 26–28 września 2022 roku w Warszawie.

3. Konferencja składa się z dwóch części:

1)  część „Dojo” odbywająca się w dniu 26 września 2022 roku w Centrum Konferencyjnym Zielna.

2) część „ABE22” odbywająca się w dniach 27-28 września 2022 roku w Multikino Złote Tarasy.

4. Możliwy jest udział wyłącznie w części „ABE22” oraz w obu częściach „Dojo” i „ABE22” łącznie.

5. Wszelkie szczegóły dotyczące Konferencji, takie jak program, sylwetki prelegentów, opisy poszczególnych wystąpień, dostępne są na Stronie Konferencji. Organizator zastrzega sobie prawo do dokonywania zmian w programie Konferencji z uwagi na okoliczności od niego niezależne. Wszelkie zmiany będą komunikowane na Stronie Konferencji.

6. Organizator zastrzega sobie prawo do odwołania lub przełożenia terminu Konferencji, jak również do zmiany miejsca Konferencji z przyczyn niezależnych od Organizatora. W przypadku odwołania Konferencji, Kupujący otrzymają zwrot całości kwoty zapłaconej za bilety. W przypadku zmiany miejsca lub terminu Konferencji, Kupujący może w ciągu 7 dni od poinformowania go o zmianie odstąpić od Umowy. W takiej sytuacji, Kupujący otrzyma zwrot całości kwoty zapłaconej za bilety.

7. Udział w Konferencji jest odpłatny, z zastrzeżeniem ust. 8 poniżej. Opłaty związane z uczestnictwem w Konferencji zamieszczone są na Stronie Konferencji i wyrażone są w kwocie netto, do której należy doliczyć podatek VAT wg aktualnie obowiązującej stawki w Rzeczypospolitej Polskiej. Organizator zastrzega sobie prawo do udzielania rabatów od cen podstawowych zamieszczonych na Stronie Konferencji.

8. Organizatorowi przysługuje prawo do zapewnienia nieodpłatnego udziału w Konferencji wybranym przez siebie osobom, w szczególności sponsorom, prelegentom, przedstawicielom mediów, zwycięzcom konkursów, osobom zaangażowanym w organizację Konferencji. Osoby takie powinny mimo wszystko przejść przez proces rejestracji, zgodnie z postanowieniami § 4 Regulaminu, korzystając z kodu rabatowego przekazanego przez Organizatora pozwalającego na nieodpłatną rejestrację.

§3
Zakup biletów

1. Udział w Konferencji możliwy jest na podstawie posiadanego biletu.

2. Zakup biletów możliwy jest za pośrednictwem Strony Konferencji.

3. W celu zakupu biletów, należy podjąć następujące kroki:

1) wybrać rodzaj biletu uprawniającego do udziału w Konferencji,

2) określić ilość biletów,

3) przejść do koszyka,

4) wypełnić formularz zamówienia, podając dane takie tak imię i nazwisko albo firma, adres e-mail, numer telefonu, adres zamieszkania albo adres siedziby, numer identyfikacji podatkowej oraz ewentualne dodatkowe uwagi,

5) wybrać sposób płatności (tradycyjny przelew bankowy albo płatność on-line kartą płatniczą za pośrednictwem serwisu PayPal albo płatność on-line za pośrednictwem serwisu Przelewy24),

6) zaakceptować Regulamin,

7) kliknąć w przycisk finalizujący zamówienie.

4. W przypadku wyboru płatności on-line, po kliknięciu w przycisk finalizujący zamówienie nastąpi przekierowanie do odpowiedniego serwisu pośrednika celem dokonania płatności. Po skutecznym dokonaniu płatności nastąpi zwrotne przekierowanie na stronę z potwierdzeniem rejestracji.

5. W przypadku wyboru płatności tradycyjnym przelewem bankowym, po kliknięciu w przycisk finalizujący zamówienie nastąpi przekierowanie na stronę z potwierdzeniem rejestracji i danymi do przelewu.

6. W ramach formularza zamówienia możliwe jest podanie kodu rabatowego w celu obniżenia kwoty do zapłaty.

7. Na adres e-mail podany podczas rejestracji zostanie wysłana wiadomość z potwierdzeniem zakupu biletów i szczegółami związanymi z udziałem w Konferencji, w tym informacje związane z przekazaniem Organizatorowi danych faktycznych uczestników Konferencji (tzw. rejestracja uczestników).

8. Faktura zostanie doręczona Kupującemu drogą elektroniczną na adres e-mail podany w formularzu zamówienia.

9. Dla każdego Kupującego zostanie utworzone konto użytkownika na Stronie Konferencji. Dostęp do konta odbywa się z wykorzystaniem adresu e-mail oraz hasła podanych w formularzu zamówienia. Z poziomu konta Kupujący może zarządzać swoimi danymi przypisanymi do konta oraz szczegółami związanymi z Konferencją. Konto może zostać w każdej chwili usunięte po indywidualnym kontakcie w tej sprawie z Organizatorem. Usunięcie konta nie powoduje usunięcia informacji o złożonym zamówieniu.

§4
Rejestracja nieodpłatna

1. Osoby, które mają zapewniony nieodpłatny udział w Konferencji proszone są mimo wszystko o przejście przez proces rejestracji odpowiadający zakupowi biletów opisanemu w § 3 Regulaminu z tą różnicą, że podanie podanie kodu rabatowego uzyskanego od Organizatora pozwoli na nieodpłatną rejestrację bez konieczności płatności za bilet.

2. Celem uniknięcia wątpliwości, postanawia się, że w sytuacji, w której osoby mające zapewniony udział w Konferencji, w szczególności prelegenci, nie przejdą przez proces rejestracji opisany w § 3 Regulaminu, biorąc udział w Konferencji stają się jej Uczestnikami i są związani postanowieniami Regulaminu.

§5
Udział w Konferencji

1. Konferencja odbędzie się w formie on-line, na dedykowanej platformie. Udział w Konferencji jest możliwy w czasie rzeczywistym. Ponadto, po zakończeniu Konferencji Organizator udostępni na swoim kanale YouTube, przez określony czas, nie krótszy niż miesiąc, nagrania z  Konferencji.

2. Adres platformy internetowej, na której odbędzie się Konferencja, a także indywidualny login i hasło zostaną przesłane do zarejestrowanego Uczestnika, który opłacił udział w Konferencji na adres e-mail podany podczas rejestracji, na co najmniej 24 godziny przed zaplanowanym rozpoczęciem Konferencji. Materiały niezbędne do udziału w Konferencji Organizator udostępni Uczestnikowi na adres poczty e-mail podany podczas rejestracji, na co najmniej trzy dni przed rozpoczęciem Konferencji.

§6
Zachowanie podczas Konferencji

1. Uczestnik ma obowiązek posługiwać w konferencji się prawdziwymi (zgodnymi ze stanem prawnym) danymi, w tym danymi osobowymi.

2. Uczestnicy Konferencji zobowiązani są zachowywać się w sposób kulturalny, niezakłócający przebiegu Konferencji, porządku publicznego, , przepisów prawa, a także nie naruszający dóbr osobistych innych Uczestników, nie wpływający negatywnie na dobre imię Organizatora lub w inny sposób wyrządzający lub mogący wyrządzić szkodę Organizatorowi lub innym Uczestnikom.

3. W razie zachowania sprzecznego z ust. 1 lub 2 powyżej, Organizator uprawniony jest do usunięcia Uczestnika z Konferencji i uniemożliwienia ponownego dołączenia do Konferencji. W takiej sytuacji, Kupującemu nie przysługuje zwrot płatności, ani jakiejkolwiek jej części, dokonanej z tytułu Umowy.

4. Z uwagi na niemożliwość przewidzenia wszystkich zagrożeń związanych z zachowaniem Uczestników podczas Konferencji, Organizator zachowuje prawo do podejmowania bieżących decyzji w sprawach nieujętych w Regulaminie. Jeżeli taka decyzja doprowadzi do wykluczenia Uczestnika z udziału w Konferencji, Kupującemu nie przysługuje zwrot płatności, ani jakiekolwiek jej części, dokonanej z tytułu Umowy.

§7
Świadczenia Organizatora

1. Organizator zapewnia uczestnikom Konferencji możliwość uczestnictwa we wszystkich prelekcjach, warsztatach, panelach itp. odbywających się w czasie Konferencji oraz materiały pokonferencyjne.

2. Umowę uważa się za wykonaną przez Organizatora poprzez samo stworzenie Kupującemu możliwości wzięcia udziału w Konferencji. W sytuacji, w której Kupujący lub Uczestnicy, dla których Kupujący kupił bilety uprawniające do udziału w Konferencji, nie wezmą udziału w Konferencji lub jakimkolwiek jej elemencie, a nie doszło uprzednio do skutecznego odstąpienia od Umowy lub rozwiązania Umowy za porozumieniem stron, Kupującemu nie przysługuje zwrot płatności, ani jakiejkolwiek jej części, dokonanej z tytułu Umowy.

§8
Wizerunek

1. Biorąc udział w Konferencji, Uczestnik przyjmuje do wiadomości, że podczas Konferencji mogą być wykonywane zdjęcia, nagrania video lub audio-video lub transkrypty w celu stworzenia, a następnie rozpowszechniania w Internecie różnego rodzaju relacji z Konferencji.

2. Organizator niniejszym informuje Uczestnika, że zgodnie z art. 81 ust. 2 pkt 2 ustawy o prawie autorskim i prawach pokrewnych zezwolenia nie wymaga rozpowszechnianie wizerunku osoby stanowiącej jedynie szczegół całości. Niezależnie od tego, biorąc udział w Konferencji, Uczestnik wyraża zgodę na rozpowszechnianie swojego wizerunku utrwalonego na zdjęciach lub nagraniach wykonanych podczas Konferencji. Zgoda obejmuje rozpowszechnianie zdjęć i nagrań w Internecie w celach związanych z relacjonowaniem, recenzowaniem, opisywaniem lub promowaniem Konferencji. Cofnięcie zgody możliwe jest poprzez indywidualny kontakt z Organizatorem, w szczególności za pośrednictwem poczty elektronicznej (gdpr@agilebyexample.com). Cofnięcie zgody działa wyłącznie na przyszłość i nie wpływa na legalność rozpowszechniania wizerunku przed cofnięciem zgody.

3. W sytuacji, w której Uczestnik dobrowolnie bierze udział w nagraniu video, udzielając krótkiej wypowiedzi, wyraża zgodę na wykorzystanie swojego wizerunku, imienia i nazwiska, stanowiska służbowego, ewentualnej informacji o pracodawcy, instytucji, którą reprezentuje, głosu i wypowiedzi udzielonych przed kamerą, w celu rozpowszechniania zrealizowanego w ten sposób nagrania w celach związanych z relacjonowaniem, recenzowaniem, opisywaniem lub promowaniem Konferencji. Udzieloną zgodę Uczestnik może w każdej chwili cofnąć. Cofnięcie zgody możliwe jest poprzez indywidualny kontakt z Organizatorem, w szczególności za pośrednictwem poczty elektronicznej (gdpr@agilebyexample.com). Cofnięcie zgody działa wyłącznie na przyszłość i nie wpływa na legalność rozpowszechniania wizerunku przed cofnięciem zgody.

§9
Dane osobowe

1. Administratorem danych osobowych Kupujących i Uczestników jest Organizator.

2. Jeżeli Kupujący przekazuje Organizatorowi dane osobowe Uczestników, oświadcza, że jest uprawniony do ich przekazania Organizatorowi w celu zapewnienia Uczestnikom udziału w Konferencji i poinformował Uczestników o celu przekazania danych oraz przetwarzania tych danych przez Organizatora.

3. Dane osobowe Kupujących oraz Uczestników przetwarzane są przez Organizatora w celu wykonania Umowy (art. 6 ust. 1 lit. b RODO), wywiązywania się z obowiązków rachunkowych wynikających z przepisów prawa (art. 6 ust. 1 lit. c RODO), w celu ustalenia, dochodzenia lub obrony roszczeń oraz w celach statystycznych, co stanowi uzasadniony interes Organizatora (art. 6 ust. 1 lit. f RODO).

4. Organizator powierza przetwarzanie danych osobowych Kupujących i Uczestników swoim podwykonawcom, takim jak biuro rachunkowe, hostingodawca, dostawca usługi poczty elektronicznej, dostawca systemu mailingowego, firma kurierska, podmioty świadczące na rzecz Organizatora usługi związane z organizacją Konferencji.

5. W związku z tym, że Organizator korzysta z usług Google, dane Kupujących i Uczestników mogą być przekazywane do Stanów Zjednoczonych Ameryki (USA) w celu ich przechowywania na serwerach Google. Google przystąpiło do programu Privacy Shield i w ten sposób zapewnia odpowiedni poziom ochrony danych osobowych.

6. Dane osobowe Kupujących i Uczestników będą przechowywane do czasu upływu terminu przedawnienia roszczeń z tytułu Umowy, a następnie w celach statystycznych do czasu zakończenia prowadzenia działalności gospodarczej przez Organizatora, przy czym po upływie terminu przedawnienia roszczeń z tytułu Umowy, Kupujący lub Uczestnik mogą sprzeciwić się dalszemu przetwarzaniu danych osobowych, co spowoduje usunięcie danych. Jeżeli chodzi o dane osobowe zawarte w dokumentach księgowych, będą one przechowywane przez okres wymagany przepisami prawa.

7. Organizator może zapewniać pewne dodatkowe świadczenia lub możliwości dla uczestników dotychczas organizowanych edycji Konferencji. W przypadku, w którym Kupujący lub Uczestnik zażąda usunięcia danych z bazy Organizatora, skorzystanie z tych świadczeń lub możliwości będzie niemożliwe.

8. W ramach działań pokonferencyjnych, Organizator może wysyłać do Uczestników wiadomości e-mail związane z Konferencją. Uczestnik może w każdej chwili sprzeciwić się temu, wypisując się z listy subskrypcyjnej poprzez kliknięcie w przycisk widoczny w każdej wysyłanej do niego wiadomości. W takiej sytuacji, Uczestnik musi liczyć się z tym, że nie wszystkie materiały konferencyjne dotrą do niego.

9. W zakresie wizerunku Uczestników utrwalonych w związku uczestnictwem w Konferencji, materiały zawierające wizerunki mogą być rozpowszechniane w Internecie, a co za tym idzie nie jest możliwe jednoznaczne wskazanie okresu przetwarzania danych osobowych w postaci wizerunku. Uczestnikowi przysługuje natomiast prawo do zażądania usunięcia materiałów zawierających jego wizerunek. Żądanie takie nie ma wpływu na legalność dokonanego uprzednio rozpowszechnienia materiałów, które to rozpowszechnienie dokonywane jest na podstawie przepisów prawa (art. 81 ustawy o prawie autorskim) lub na podstawie zgody Uczestnika, o której mowa w § 8 Regulaminu.

10. W związku z przetwarzaniem danych osobowych przez Organizatora, Kupującym i Uczestnikom przysługują następujące uprawnienia:

1) prawo dostępu do danych,

2) prawo do sprostowania danych,

3) prawo do usunięcia danych,

4) prawo do ograniczenia przetwarzania danych,

5) prawo do wniesienia sprzeciwu wobec przetwarzania,

6) prawo do przenoszenia danych,

7) prawo do wniesienia skargi do organu nadzorczego (Prezesa Urzędu Ochrony Danych Osobowych).

11. Realizacja uprawnień możliwa jest poprzez indywidualny kontakt z Organizatorem, w szczególności za pośrednictwem poczty elektronicznej (gdpr@agilebyexample.com). Organizator poucza niniejszym Kupujących i Uczestników, że ich uprawnienia, o których mowa powyżej nie mają charakteru bezwzględnego i mogą ustępować nadrzędnym interesom Organizatora jako administratora danych osobowych. Organizator zachęca w tym zakresie Kupujących i Uczestników do zapoznania się z art. 16 – 21 RODO. W celu ułatwienia Kupującym i Uczestnikom zrozumienia przywołanych przepisów, Organizator niniejszym wymienia przykładowo sytuacje, gdy poszczególne uprawnienia Kupujących lub Uczestników nie będą mogły zostać zrealizowane:

1) sprostowanie danych zawartych na fakturach możliwe jest wyłącznie poprzez posłużenie się korektą faktury lub notą korygującą,

2) usunięcie danych dotyczących zawartych Umów nie będzie możliwe wcześniej niż po upływie okresu przedawnienia roszczeń dotyczących Umów,

3) sprzeciw w stosunku do przetwarzania danych Uczestników nie będzie możliwy w trakcie realizacji Umowy, ponieważ uniemożliwiłoby to Organizatorowi należyte wykonanie Umowy.

12. Podanie danych osobowych jest dobrowolne, ale niezbędne do zawarcia Umowy i wzięcia udziału w Konferencji.

§10
Prawa własności intelektualnej

Organizator poucza niniejszym Uczestników, że materiały udostępniane Uczestnikom w związku z udziałem w Konferencji, jak również treści prezentowane podczas Konferencji mogą być objęte ochroną prawa autorskiego oraz prawa własności przemysłowej, a ich dalsze rozpowszechnianie może stanowić naruszenie praw podmiotów uprawnionych dające podstawę do pociągnięcia do odpowiedzialności cywilnej lub karnej.

§11
Reklamacje

1. Wszelkie reklamacje związane z Konferencją mogą być zgłaszane w formie pisemnej na adres Organizatora lub w formie elektronicznej na adres e-mail info@agilebyexample.com.

2. Reklamacja powinna zawierać dane pozwalające na identyfikację osoby reklamującej i podjęcie z nią kontaktu, uzasadnienie reklamacji oraz żądania z nią związane.

3. Reklamacje będą rozpatrywane w terminie 14 dni od daty doręczenia reklamacji Organizatorowi. Organizator ustosunkuje się do reklamacji w takiej samej formie, w jakiej reklamacja została mu doręczona.

§12
Rezygnacja

1. Każdy Kupujący może odstąpić od Umowy zawartej z Organizatorem najpóźniej na 14 dni przed pierwszym dniem Konferencji. Odstępne wynosi 30% kwoty zapłaconej Organizatorowi z tytułu Umowy i zostanie potrącone przez Organizatora z kwoty zwracanej Kupującemu. Możliwe jest również odstąpienie od Umowy w części, tj. w zakresie tylko niektórych z zakupionych biletów uprawniających do wzięcia udziału w Konferencji. Zwrot płatności po potrąceniu odstępnego zostanie dokonany nie później niż w ciągu 14 dni od poinformowania Organizatora o odstąpieniu od Umowy.

2. Ponadto, Konsument może odstąpić od Umowy zawartej z Organizatorem bez podawania przyczyny w ciągu 14 dni od zawarcia Umowy, nie później niż do dnia rozpoczęcia Konferencji. W tym celu Konsument musi poinformować Organizatora o swojej decyzji, np. wysyłając wiadomość na adres info@agilebyexample.com. W takiej sytuacji, Organizator zwróci Konsumentowi wszystkie otrzymane od niego z tytułu Umowy płatności. Zwrot nastąpi niezwłocznie, nie później niż w ciągu 14 dni od poinformowania Organizatora o odstąpieniu od umowy.

3. Uprawnienia Konsumenta, o których mowa w ust. 2 powyżej, przysługują także osobie fizycznej zawierającej umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej, udostępnionego na podstawie przepisów o Centralnej Ewidencji i Informacji o Działalności Gospodarczej.

4. W celu uniknięcia wątpliwości, Organizator informuje niniejszym Kupującego, że w sytuacji, gdy Kupujący nie jest Konsumentem, Kupujący nie może odstąpić od Umowy później niż na 14 dni przed pierwszym dniem Konferencji. Jeżeli Kupujący lub Uczestnicy nie wezmą udziału w Konferencji, Kupującemu nie przysługuje zwrot dokonanej płatności z tytułu Umowy.

§13
Postanowienia końcowe

1. Regulamin został przygotowany w oparciu o prawo polskie. Prawem właściwym dla Umów jest prawo polskie, z tym zastrzeżeniem, że nie pozbawia to Konsumentów możliwości powoływania się na przepisy ich ojczystego prawa, które są dla nich korzystniejsze niż rozwiązania przyjęte w prawie polskim.

2. Wszelkie spory związane z udziałem w Konferencji będzie rozpatrywać sąd powszechny właściwy ze względu na miejsce siedziby Organizatora. Postanowienie to nie dotyczy Konsumentów, w przypadku których zastosowanie znajduje właściwość miejscowa ogólna sądu.

3. Konsument ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. Między innymi, Konsument ma możliwość:

1) zwrócenia się do stałego polubownego sądu konsumenckiego z wnioskiem o rozstrzygnięciu sporu wynikłego z zawartej umowy,

2) zwrócenia się do wojewódzkiego inspektora Inspekcji Handlowej z wnioskiem o wszczęcie postępowania mediacyjnego w sprawie polubownego zakończenia sporu między Konsumentem a Właścicielem Serwisu,

3) skorzystania z pomocy powiatowego (miejskiego) rzecznika prawa konsumenta lub organizacji społecznej, do której statutowych zadań należy ochrona konsumentów.

4. Bardziej szczegółowych informacji na temat pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, Konsument może szukać na stronie internetowej http://polubownie.uokik.gov.pl.

5. Konsument może również skorzystać z platformy ODR, która dostępna jest pod adresem http://ec.europa.eu/consumers/odr. Platforma służy rozstrzyganiu sporów pomiędzy konsumentami i przedsiębiorcami dążącymi do pozasądowego rozstrzygnięcia sporu dotyczącego zobowiązań umownych wynikających z internetowej umowy sprzedaży lub umowy o świadczenie usług.
